Terms of Service

1. Acceptance of Terms

By accessing or using Lake Erie Pulse ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Description of Service

Lake Erie Pulse provides:

  • Real-time lake conditions, marine forecasts, and weather data aggregated from public government sources
  • A boat inventory marketplace featuring dealer and private seller listings
  • A marine business directory
  • Community fishing reports and species guides
  • Trip planning tools with weather-aware routing
  • Beach water quality monitoring data
  • Dealer and business partner portals for listing management

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information when creating an account. You must be at least 18 years old to create an account.

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

4. Boat Listings

Dealer Listings: Boat inventory from dealers is sourced from publicly available dealer websites. We display this information to help buyers discover boats and drive traffic to dealers. Dealers can claim their listings through our partner program.

Private Seller Listings: Private sellers may list boats for sale on the Platform. All private listings are subject to review and approval. We reserve the right to reject or remove any listing at our discretion.

Accuracy: Lake Erie Pulse does not guarantee the accuracy of any boat listing including pricing, specifications, availability, or condition. Buyers should verify all information directly with the seller or dealer.

No Transaction Facilitation: Lake Erie Pulse is a listing platform. We do not facilitate, broker, or guarantee any sale or transaction between buyers and sellers. All transactions occur directly between the parties involved.

5. Dealer & Business Partners

Dealers and businesses can sign up for partner accounts to manage their listings, create promotions, and post events. Partner accounts require approval and are subject to the following:

  • You must be an authorized representative of the business you register
  • All information provided must be accurate and current
  • We reserve the right to revoke partner access at any time
  • Premium features may require a paid subscription with a 6% service fee on applicable charges

6. Lead Generation & Quote Requests

When a user submits a quote request for a boat listing, their contact information is shared with the listing dealer or seller. Dealers and sellers agree to handle leads professionally and in compliance with applicable laws including CAN-SPAM and TCPA.

7. Community Content

Users may submit catch reports, trip reviews, and other community content. By submitting content, you grant Lake Erie Pulse a non-exclusive, royalty-free license to display and use that content on the Platform. You represent that you have the right to share any content you submit.

We reserve the right to remove any community content that is offensive, misleading, or violates these terms.

8. Weather & Safety Data Disclaimer

Lake Erie Pulse is not a substitute for official weather forecasts or marine safety advisories. All weather data, buoy readings, wave heights, and marine forecasts are sourced from NOAA, NWS, and other government agencies and are provided for informational purposes only.

Always check official NOAA marine forecasts before going on the water. Lake Erie Pulse is not responsible for any decisions made based on data displayed on the Platform. Boating involves inherent risks — exercise proper judgment and follow all Coast Guard safety requirements.

9. Intellectual Property

The Lake Erie Pulse name, logo, website design, and original content are the property of Lake Erie Pulse. Government data (NOAA, NWS, USGS) is public domain. Boat listing images and descriptions are the property of their respective dealers and sellers.

10. Limitation of Liability

Lake Erie Pulse is provided "as is" without warranties of any kind. We are not liable for:

  • Inaccuracies in weather data, boat listings, or business directory information
  • Any loss or damage resulting from use of the Platform or reliance on data displayed
  • Any transaction between buyers and sellers facilitated through the Platform
  • Temporary unavailability of the Platform or data feeds

11. Prohibited Uses

You agree not to:

  • Use automated tools to scrape or harvest data from the Platform
  • Post fraudulent listings or misleading business information
  • Harass other users, dealers, or businesses
  • Attempt to gain unauthorized access to accounts or systems
  • Use the Platform for any unlawful purpose

12. Changes to Terms

We may update these terms from time to time. Continued use of the Platform after changes constitutes acceptance of the new terms.

13. Governing Law

These terms are governed by the laws of the State of Ohio. Any disputes shall be resolved in the courts of Ohio.
